{"id":34146,"date":"2015-01-05T16:35:02","date_gmt":"2015-01-05T15:35:02","guid":{"rendered":"http:\/\/www.leblogimmo.nicolas-devillard.fr\/?p=16"},"modified":"2020-05-11T13:14:58","modified_gmt":"2020-05-11T11:14:58","slug":"mandat-exclusif-les-avantages-pour-le-vendeur","status":"publish","type":"post","link":"https:\/\/www.nicolas-devillard.fr\/en\/mandat-exclusif-les-avantages-pour-le-vendeur\/","title":{"rendered":"Mandat exclusif : les avantages pour le vendeur"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Lorsqu\u2019un vendeur mandate un agent immobilier, ce mandat peut \u00eatre de deux types.<\/h2>\n\n\n\n<p>Exclusif : le mandant ne confie pas d\u2019autre mandat \u00e0 d\u2019autres agences ni ne s\u2019autorise \u00e0 traiter en direct avec un acqu\u00e9reur,<br>Sans exclusivit\u00e9 : il garde toute latitude pour mandater autant d\u2019agences qu\u2019il le souhaite, voire vendre directement \u00e0 un client sans interm\u00e9diaire.<br>Souvent \u00e9cart\u00e9 par principe, notamment par crainte d\u2019\u00eatre \u00ab coinc\u00e9 \u00bb avec une agence peu efficace, les vendeurs ne per\u00e7oivent pas toujours les avantages de signer un mandat exclusif. Ils sont pourtant nombreux. Par exemple, le mandat exclusif permet de :<\/p>\n\n\n\n<p>1) Eviter une surexposition du bien par la multiplication des annonces,<br>2) Eviter de donner l\u2019impression que le vendeur \u00ab panique \u00bb et n\u2019a pas confiance en la qualit\u00e9 de son appartement,<br>3) Ne pas brouiller l\u2019image de l\u2019appartement par des annonces d\u2019agences trop divergentes : prix diff\u00e9rents, informations incoh\u00e9rentes, photos de qualit\u00e9 in\u00e9gale,<br>4) Pr\u00e9server la confidentialit\u00e9 et la s\u00e9curit\u00e9 du bien,<br>5) Faciliter la gestion des visites, \u00e0 fortiori quand l\u2019appartement est encore habit\u00e9 par le vendeur,<br>6) Motiver l\u2019agent immobilier : un mandat exclusif est un engagement r\u00e9ciproque qui oblige l\u2019agence \u00e0 plus de diligences et de d\u00e9marches pour accomplir sa mission.<\/p>\n\n\n\n<p>L\u2019id\u00e9e que mandater 2, 3 ou 4 agences va cr\u00e9er une saine \u00e9mulation est fausse : cette strat\u00e9gie ne sert qu\u2019\u00e0 amoindrir la motivation des professionnels. Leur engagement sera inversement proportionnel au nombre de mandats sign\u00e9s, d\u2019autant plus durant cette p\u00e9riode qui voit fr\u00e9quemment les ventes ou les locations se conclure apr\u00e8s plusieurs mois de commercialisation.<\/p>\n\n\n\n<p>Enfin, il est utile de rappeler les faits suivants :<\/p>\n\n\n\n<p>&#8211; une agence ne doit accepter un mandat exclusif que lorsqu\u2019elle est confiante sur ses chances de r\u00e9ussite,<br>&#8211; une agence s\u2019engage avec un mandat exclusif, contrairement \u00e0 un mandat simple que certaines agences utilisent comme moyen d\u2019enrichir le portefeuille de biens propos\u00e9s et se servent alors de l\u2019appartement comme faire-valoir pour vendre d\u2019autres biens,<br>&#8211; internet permet aujourd\u2019hui de toucher tous les v\u00e9ritables clients, bien plus s\u00fbrement qu\u2019une belle vitrine ou qu\u2019un fichier,<br>&#8211; l\u2019exclusivit\u00e9 n\u2019est pas \u00e9ternelle, elle dure en g\u00e9n\u00e9ral 3 mois. Il est possible de modifier cette dur\u00e9e en accord avec son agent immobilier en prenant en compte la p\u00e9riode de l\u2019ann\u00e9e et le type de transaction.<\/p>\n\n\n\n<p>Vous me direz qu\u2019il serait \u00e9tonnant qu\u2019un agent immobilier ne d\u00e9fende pas le principe du mandat exclusif. Mais l\u2019int\u00e9r\u00eat du vendeur et de l\u2019agence sont li\u00e9s, car il s\u2019agit de vendre dans de bonnes conditions : s\u00e9curit\u00e9, prix juste et d\u00e9lai
