Si vous ajoutez \u00e0 ce contexte une fiscalit\u00e9 alourdie, il n&#8217;est pas \u00e9tonnant qu&#8217;un propri\u00e9taire h\u00e9site \u00e0 se lancer dans l\u2019aventure locative qui semble tr\u00e8s hasardeuse\u2026<\/p>\n\n\n\n<p>Le r\u00e9sultat imm\u00e9diat et le plus visible est une contraction de l&#8217;offre locative, notamment pour les petites surfaces. Pire encore, seuls les locataires b\u00e9n\u00e9ficiant de dossiers de solvabilit\u00e9 ultra-rassurants (caution solidaire ou bancaire, emploi salari\u00e9 en CDI, ou encore d\u00e9tention d&#8217;un bien immobilier par exemple) voient leur candidature retenue par des bailleurs d\u00e9sireux de limiter au maximum la prise de risque. Qui a cherch\u00e9 un jour \u00e0 faire expulser un mauvais payeur comprend cette exigence.<\/p>\n\n\n\n<p>Et pourtant, l&#8217;immense majorit\u00e9 des locataires respectent scrupuleusement leur premier et principal engagement: le paiement du loyer. Mais ils font les frais d&#8217;une minorit\u00e9 qui rencontrent des difficult\u00e9s financi\u00e8res, ou de ceux qui abusent du droit pour ne pas payer, et qui trouvent dans la loi une alli\u00e9e d\u00e9tourn\u00e9e de son objectif premier.<\/p>\n\n\n\n<p>Les effets pervers de ce cadre l\u00e9gislatif d\u00e9s\u00e9quilibr\u00e9 pourraient pourtant \u00eatre r\u00e9duits : oui \u00e0 l&#8217;encadrement des loyers, \u00e0 des biens mieux entretenus, et \u00e0 des limites aux garanties exigibles par les bailleurs, mais en contrepartie, des proc\u00e9dures acc\u00e9l\u00e9r\u00e9es et facilit\u00e9es pour recouvrer des loyers voire pour expulser un locataire mauvais payeur.<\/p>\n\n\n\n<p>Si les bailleurs se sentaient soutenus par l&#8217;\u00e9tat face aux locataires &#8220;ind\u00e9licats&#8221;, il y a assez peu de doute qu&#8217;ils se risqueraient \u00e0 accepter plus facilement des candidats aux dossiers moins &#8220;b\u00e9tonn\u00e9s&#8221;.
